Connected Care MyChart Terms and Conditions of Use


Your health care provider ("Provider") is pleased to offer you information via a web-based

version of its electronic health records through a system called Connected Care MyChart.

These Term and Conditions describe important aspects of the system and govern your use of

Connected Care MyChart. Please read these Terms and Conditions carefully.


BY CLICKING "ACCEPT" BELOW, OR BY USING CONNECTED CARE MYCHART, YOU SIGNIFY

YOUR AGREEMENT TO THESE TERMS AND CONDITIONS.


Response to Electronic Communication - Your Provider will use best efforts to provide a

timely response to electronic inquiries (emails and other electronic communication). In some

cases, the clinic staff who needs to respond to an electronic inquiry or other communication

may not be immediately available. You should allow at least three (3) business days for a

response. Accordingly, communications related to emergency situations requiring immediate

attention should not be submitted electronically.


Your Provider is only able to respond to electronic communications based on the information

provided by you, the patient. If there is insufficient information provided, your Provider will

be unable to provide accurate and reliable services.


Website Links – Connected Care MyChart may offer links to related medical websites not

managed by Connected Care MyChart or your Provider. These website link(s) are for your

informational purposes only. Your Provider and Connected Care MyChart do not endorse and

has not verified the accuracy of the information in/on these websites, and you should not rely

on any of the information found on the websites for purposes of treatment or diagnosis.


E-mail Privacy - As a user of Connected Care MyChart, you should be aware that you will be

notified via e-mail when there is new medical information to be viewed on Connected Care

MyChart. This means that any person with access to your email will be able to see this

notification. This could include your family members, employer or anyone else who can

access your e-mail account. Although no private medical information will be sent, the

notification that new medical information is available by accessing Connected Care MyChart

may be information that you would not want others to know. Thus, you should take this into

account when providing an e-mail address or using Connected Care MyChart.


If you send an e-mail communication, it may be shared with your Provider's clinical staff who

assist in providing your medical care. Your confidential medical information on Connected

Care MyChart will be accessible only to appropriate staff.


Security and Confidentiality - Your Provider affords the same degree of confidentiality to

medical information stored on Connected Care MyChart as is given to medical information

stored by your Provider in any other medium. Your Provider is committed to protecting the

confidentiality of your medical information. Provider staff access and ability to enter or view

information is limited based upon their role in your care. Firewalls, passwords, encryption,

and audit trails are further used to safeguard your information. The Connected Care MyChart

system identifies the records released and note the time and date of access each time you

access Connected Care MyChart. The Connected Care MyChart system includes mechanisms

to make information received from our online visitors secure against unauthorized access

and use.


For other than general information view, Connected Care MyChart must be accessed with a

Secure Sockets Layer (SSL) compatible browser or terminal (Netscape or Internet Explorer

versions 5.0 or greater). SSL web server uses authentication and offers the highest level of

encryption technology commercially available (128-bit RC4). Connected Care MyChart

incorporates encryption technologies that may be restricted under U.S. export control rules,

if utilized outside of the U.S. Territories.


You can tell when you are secure by looking at the location (URL) field. If the URL begins with

https:// (instead of http://), the document comes from a secure server. This means your data

cannot be read or deciphered by unauthorized individuals. You can tell whether you are truly

connected to Connected Care MyChart by viewing the digital certificate. This certificate

verifies the connection between Connected Care MyChart server's public key and the server's

identification.


User names and passwords provide two layers of authentication and are stored in an

encrypted database that is isolated from the Internet. As a Connected Care MyChart user,

your role in maintaining the security of your medical information is to: (1) change your

password on a regular basis, and (2) keep your login ID and password confidential.


Laboratory Tests - You may use this Connected Care MyChart to view certain information

displayed from your medical records, including the results of certain laboratory tests. Your

use of the Connected Care MyChart is considered to be a request by you to receive your lab

test results online.


User Participation - Any personal information you submit via Connected Care MyChart is

governed by your Provider's notice of privacy practices and these Terms and Conditions. This

includes information on your rights to see and receive copies of your personal health

information. To deactivate your Connected Care MyChart account, please contact your

Provider's office. To the extent there is an inconsistency between these Terms and Conditions

and your Provider's notice of privacy practices, these Terms and Conditions shall govern.

Please note that your access to Connected Care MyChart may be revoked at any time, and for

any reason.


User / Device Data Collection


I understand that in some situations I can choose to connect my personal device(s) (such as

mobile phones, pedometers, or heart rate monitors) to Connected Care MyChart via a data

interface. Any information collected or retained in this way may be used to facilitate my

health care and may be made part of my permanent health record.


Limitations on Use of MyChart


You agree that you will not upload or transmit any communications or content of any type

(including secure messaging and E-visit / Video Visit) that may infringe upon, misappropriate,

or violate the law or the rights of any party. You agree that the following actions shall

constitute a material breach of these Terms and Conditions:

• signing on as or pretending to be another person

• transmitting messages or material that infringes on or violates the intellectual property rights

of others or the privacy or publicity rights of others

• transmitting material that is unlawful, obscene, defamatory, predatory of minors,

threatening, harassing, abusive, slanderous, or hateful to any person or entity

• using MyChart's interactive services in any way that is intended or is reasonably likely to harm

the patient or others

• intentionally distributing viruses or other harmful computer code

Connected Care expressly reserves the right, in its sole discretion, to terminate a user's access

to MyChart due to any act that would constitute a violation of these Terms and Conditions.


Web Site Revisions


We may revise the information on MyChart, or otherwise change or update MyChart, including

these Terms and Conditions, without notice to you. Connected Care may also make

improvements and/or changes in products and/or services described on MyChart or add new

features at any time without notice. We encourage you to periodically read these Terms and

Conditions to see if there have been any changes to our policies that may affect you. Your

continued use of MyChart will signify your continued agreement to these Terms and

Conditions as they may be revised.

CONNECTED CARE MYCHART AND ALL RELATED SERVICES ARE PROVIDED "AS IS," WITH ALL

FAULTS, WITH NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESSED OR

IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF

MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. YOU 

ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THIS SITE, ALL SITE-RELATED

SERVICES, AND THIRD PARTY WEB SITES. NO ORAL OR WRITTEN INFORMATION OR ADVICE

GIVEN BY PROVIDER OR OTHER AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY

OF ANY KIND.


Limitation of Liability


PROVIDER AND ITS AFFILIATES, SUPPLIERS, BUSINESS ASSOCIATES (INCLUDING CONNECTED

CARE) AND OTHER THIRD PARTIES ENABLING THE CONNECTED CARE MYCHART

FUNCTIONALITY ARE NEITHER RESPONSIBLE NOR LIABLE FOR ANY DIRECT, INDIRECT,

INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, OR OTHER DAMAGES

(INCLUDING, WITHOUT LIMITATION, THOSE RESULTING FROM LOST DATA) ARISING OUT OF

OR RELATING IN ANY WAY TO CONNECTED CARE MYCHART, CONTENT OR INFORMATION

CONTAINED WITHIN CONNECTED MYCHART, WHETHER BASED ON WARRANTY, CONTRACT,

TORT, OR ANY OTHER LEGAL THEORY AND WHETHER OR NOT ADVISED OF THE POSSIBILITY

OF SUCH DAMAGES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE CONNECTED CARE

MYCHART RELATED SERVICES IS TO STOP USING THE SERVICES. APPLICABLE LAW MAY NOT

ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO

THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THESE TERMS AND

CONDITIONS ARE GOVERNED BY CALIFORNIA LAW WITHOUT REGARD TO ITS PRINCIPLES OF

CONFLICTS OF LAW.
